<p>The Perry Chamber of Commerce held twin ribbon cuttings for Spellman and McDevitt Law Firm and Studio on Second on Thursday, June 13.</p>



<p><a href="http://spellmanmcdevittlaw.com/daniel-j-spellman/"><strong>Daniel Spellman</strong></a> talked about Spellman and McDevitt Law Firm and all the local help that went into the building while <a href="http://spellmanmcdevittlaw.com/annemarie-spellman-mcdevitt/"><strong>AnneMarie Spellman McDevitt</strong> </a>looked on. Sally Spellman then talked about Studio on Second before the ribbons were cut and community members were invited inside to see the renovated spaces.</p>

<p><strong>The Iowa Legislature has once again made changes to Iowa’s Workers’ Compensation Law which negatively impacts injured workers. </strong></p>



<p><strong>The most recent change involves workplace injuries resulting from a fall. Prior to the change, if an employee could prove that a condition of the worker’s employment increased the risk of injury, even falls that occurred for unknown or idiopathic reasons on level surfaces could be compensable. </strong></p>



<p><strong>The legislature amended Iowa Code Section 85.61(7) and added subsection (c) which states the following: “c. Personal injuries due to idiopathic or unexplained falls from a level surface onto the same level surface do not arise out of and in the course of the employment and are not compensable under this chapter.” This rule will apply to all work injuries occurring </strong><strong>on or after July 1, 2019.</strong><strong> </strong></p>



<p><strong>This will no doubt be an issue that is litigated extensively. </strong><br></p>

<p>There are many changes, both procedurally and substantively, that became law during the last legislative session. Overall, they were not beneficial to injured workers. A few of the changes which will have the most effect on injured workers are discussed below. All of the following changes <g class="gr_ gr_32 gr-alert gr_gramm gr_inline_cards gr_run_anim Grammar multiReplace" id="32" data-gr-id="32">relate</g> to injury dates <strong>AFTER July 1, 2017</strong>.</p>
<ol>
<li><span style="font-size: 14px;">The employer shows at the time of injury or immediately following the injury, the employee had a positive test  result reflecting the presence in their body of alcohol or another intoxicant not prescribed by a physician or used in accordance with the prescription, it will be presumed that the employee was intoxicated at the time of injury and that the intoxication was a substantial factor in causing the injury. The employee can offer evidence that they were not intoxicated or that the intoxication did not cause the injury once the presence of alcohol is proven by the employer.</span></li>
<li><span style="font-size: 14px;">Under </span><g class="gr_ gr_28 gr-alert gr_gramm gr_inline_cards gr_run_anim Grammar only-ins replaceWithoutSep" id="28" data-gr-id="28"><g class="gr_ gr_28 gr-alert gr_gramm gr_inline_cards gr_run_anim Grammar only-ins replaceWithoutSep" id="28" data-gr-id="28">Iowa</g></g><span style="font-size: 14px;"> Workers Compensation Law, the employer has the right to choose and authorize medical care. If the employee does not appear for medical examinations, the employee forfeits benefits for the period of the refusal. This has changed from a suspension of benefits to a forfeiture.</span></li>
<li>One of the biggest changes has to do with injuries to an employees’ shoulder(s). Shoulder injuries after July 1, <g class="gr_ gr_49 gr-alert gr_gramm gr_inline_cards gr_run_anim Punctuation only-ins replaceWithoutSep" id="49" data-gr-id="49"><g class="gr_ gr_49 gr-alert gr_gramm gr_inline_cards gr_run_anim Punctuation only-ins replaceWithoutSep" id="49" data-gr-id="49">2017</g></g> are now considered to be “scheduled” injuries as opposed to injuries to the whole body. (even if the shoulder injury renders the employee incapable of working). This means that the recovery is much lower for a shoulder injury after July 1, <g class="gr_ gr_51 gr-alert gr_gramm gr_inline_cards gr_run_anim Punctuation only-ins replaceWithoutSep" id="51" data-gr-id="51">2017</g> as opposed to the same injury pre- July 1, 2017.</li>
<li><span style="font-size: 14px;">If an employee is returned to work by the physician chosen by the employer in work deemed “suitable” and the employee is not able to perform the work, then the employee forfeits their benefits while they are not working if the work is deemed suitable. </span>If the employee refuses the work offered then the employee must communicate the refusal in writing to the employer or carrier or the benefits cannot be recovered.</li>
<li><span style="font-size: 14px;">If the employee is able to return to work after reaching the point of maximum medical improvement (MMI) then the employee is not owed any permanent disability benefits, only benefits for the functional rating issued by the authorized physician. However, if the employment is terminated at any time, the employee can bring a review-reopening claim at that time for permanent benefits.</span></li>
</ol>
