The Iowa Legislature has once again made changes to Iowa’s Workers’ Compensation Law which negatively impacts injured workers.
The most recent change involves workplace injuries resulting from a fall. Prior to the change, if an employee could prove that a condition of the worker’s employment increased the risk of injury, even falls that occurred for unknown or idiopathic reasons on level surfaces could be compensable.
The legislature amended Iowa Code Section 85.61(7) and added subsection (c) which states the following: “c. Personal injuries due to idiopathic or unexplained falls from a level surface onto the same level surface do not arise out of and in the course of the employment and are not compensable under this chapter.” This rule will apply to all work injuries occurring on or after July 1, 2019.
This will no doubt be an issue that is litigated extensively.
